FREE KILL

Florida’s “Free Kill” law strategically blocks grieving families from seeking legal recourse for fatal medical negligence. This leaves loved ones with no real path to justice and makes it impossible for the public to truly know the record of a hospital or physician when making choices about healthcare.

Under this law:

  • The lives of victims who are 25 or older, unmarried, and without children under 25 are deemed to be worthless
  • Families are barred from recovering pain and suffering damages, which are noneconomic damages that cannot be objectively calculated, such as emotional distress, grief, loss of companionship, mental anguish, and the physical pain endured by the injured person or the loss of the deceased victim.
  • Families are limited to economic losses associated with the death, such as the cost of an autopsy or funeral expenses.
  • The cost of seeking justice outweighs the economic damages. Therefore, victims are denied the right to equal protection under the law and their families are denied the right to due process and legal recourse/access to the courts.

This unconstitutional law is by design. A right that cannot be exercised is not a viable
right. This makes justice an illusion.

DAMAGE CAPS

Damage caps limit how much families can recover after medical negligence, regardless of how severe the harm is. These limits protect insurance companies and hospitals, not patients.

The Florida Supreme Court Ruled Damage Caps Unconstitutional-Twice.

  • No evidence caps reduced insurance premiums
  • No proof caps stabilized the insurance market
  • Insurers did not pass savings on to physicians
  • The link between caps and lower costs was deemed “purely speculative”

Damage caps place unfair and unequal burdens on the most severely injured.

COST SHIFTING

When accountability is strategically blocked, the financial consequences of medical negligence do not disappear, they are shifted. This means higher health insurance premiums, increased taxes, and strain on public programs like Medicare and Medicaid.

  • Accountability is strategically blocked
  • A medical negligence/wrongful death judgement is also blocked
  • Medical malpractice insurers dodge claims
  • Wrongdoers are not forced to repay health insurers, Medicare, or Medicaid
  • The financial burden shifts to the public
